Welcome to GambleIQ Tracker, owned and operated by DustyCheetah Labs LLC (“we,” “us,” or “our”). These Terms of Service and Gambling Disclaimer (“Terms”) govern your use of the GambleIQ Tracker mobile application, website, and any related services (collectively, the “App”). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the App.

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

1. Eligibility

You must be at least 18 years old, or the legal gambling age in your jurisdiction, to use GambleIQ Tracker. By using the App, you represent and warrant that you meet all applicable age requirements.

2. Nature of the App (No Real-Money Gambling)

GambleIQ Tracker does not facilitate, enable, or offer real-money gambling, betting, or wagering. The App does not process payments, wagers, deposits, or withdrawals. All features are intended solely for personal tracking, logging, and informational purposes related to gambling activity.

The presence of gambling-related content within GambleIQ Tracker does not constitute an offer, solicitation, or promotion of gambling activity.

3. Risk Acknowledgement

Gambling involves significant financial risk. Any gambling activity you choose to engage in—whether tracked, analyzed, or informed by GambleIQ Tracker—is done solely at your own discretion and responsibility.

The App does not use historical data, trends, or analytics to predict gambling outcomes. Any statistics, charts, or insights generated by the App are descriptive only and should never be interpreted as advice, recommendations, or indications of future results.

DustyCheetah Labs LLC makes no guarantees regarding the outcomes of any gambling activities.

4. Data Accuracy, Backups, and User Responsibility

GambleIQ Tracker does not guarantee the accuracy, completeness, or reliability of any data entered, displayed, or generated. You are solely responsible for the accuracy of any information you input into the App.

You are responsible for maintaining backups of your records. DustyCheetah Labs LLC is not responsible for lost, deleted, or corrupted data, whether due to device failure, account issues, or technical errors.

Reports generated by GambleIQ Tracker are based solely on user-entered information and should be reviewed for accuracy before being relied upon for tax, legal, or financial purposes.

5. Account Registration

Certain features of GambleIQ Tracker may require you to create an account. You agree to provide accurate, current, and complete information during registration and to maintain and update such information as needed. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts at our sole discretion for violations of these Terms or for conduct that we reasonably believe may harm the App, its users, or DustyCheetah Labs LLC.

6. Subscription and Billing Terms (If Applicable)

If GambleIQ Tracker offers premium features or subscription plans:

• Subscriptions may automatically renew unless canceled through your app store account.
• Billing, renewals, cancellations, and refunds are handled directly through Google Play or the App Store.
• We may change subscription pricing with reasonable notice.
• Access to premium features ends when a subscription is canceled or expires.

7. User Conduct

You agree not to:

• Use GambleIQ Tracker for any unlawful or prohibited purpose;
• Interfere with or disrupt the App or its systems;
• Reverse engineer, decompile, or disassemble any part of the App;
• Upload or transmit viruses, malware, or harmful code;
• Use automated tools (bots, scrapers, etc.) without authorization.

DustyCheetah Labs LLC may investigate violations and take appropriate action, including suspension or termination of access.

8. Intellectual Property

All content, features, trademarks, graphics, analytics, reports, and intellectual property associated with GambleIQ Tracker are owned by DustyCheetah Labs LLC or its licensors.

You may not:

• Copy or reproduce analytics, reports, or visualizations;
• Use screenshots or data for commercial purposes;
• Create derivative works based on the App;
• Modify, distribute, or exploit any part of the App without written permission.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. No Financial, Legal, or Professional Advice

All information provided within GambleIQ Tracker is for general informational purposes only. Nothing within the App constitutes financial, legal, tax, investment, or professional advice. You should consult qualified professionals before making any gambling-related or financial decisions.

10. Disclaimer of Warranties

GambleIQ Tracker is provided on an “as-is” and “as-available” basis. DustyCheetah Labs LLC makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

We do not guarantee the completeness or accuracy of any data, logs, analytics, or information provided through the App.

11. Limitation of Liability

To the fullest extent permitted by law, DustyCheetah Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data inaccuracies, or gambling-related losses arising from or connected to your use of GambleIQ Tracker.

Your sole remedy for dissatisfaction with the App is to stop using it.

12. Arbitration Agreement & Class-Action Waiver

By using the App, you agree that:

• Any dispute arising out of or relating to these Terms or your use of the App will be resolved through binding arbitration, not in court.
• You waive any right to participate in a class action, class arbitration, or representative proceeding.
• You agree to resolve disputes individually.

This section does not apply where prohibited by law.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Wyoming for any disputes not subject to arbitration.

14. Responsible Gambling

GambleIQ Tracker is intended to encourage responsible gambling through accurate record-keeping and self-awareness. The App is not designed to encourage increased gambling activity.

16. Boilerplate Legal Clauses

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

Entire Agreement

These Terms constitute the entire agreement between you and DustyCheetah Labs LLC regarding the App.

Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control.

Assignment

We may assign these Terms at our discretion. You may not assign them without our consent.

Electronic Acceptance

Your use of the App constitutes acceptance of these Terms electronically.
